1. Introduction and Acceptance of Terms

Welcome to QRCraft.in (“we,” “us,” “our,” or “QRCraft”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and QRCraft.in regarding your use of our website at qrcraft.in and app.qrcraft.in (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Important: These Terms contain provisions that limit our liability and require you to resolve disputes with us through binding arbitration on an individual basis, not as part of any class or representative action.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be located in India (our Service is exclusively available to Indian users)
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under Indian law or any other applicable law

By using the Service, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not use the Service.

3. Description of Service

QRCraft.in provides an online platform for designing and customizing UPI QR codes. Our Service includes:

3.1 Digital Services

• QR code design editor with templates and customization tools
• Logo integration and positioning
• Background image search (via Unsplash API integration)
• Text, color, and layout customization
• Digital file downloads in PNG, JPG, and PDF formats

3.2 Physical Products

• Acrylic Stands: Premium tabletop QR code displays (A6 size) with your custom design
• Stickers: Adhesive QR code labels (pack of 2) suitable for walls and glass

3.3 Service Limitations

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. User Accounts and Registration

Currently, QRCraft.in does not require user registration or account creation for basic design services. You may use the Service as a guest.

If we introduce user accounts in the future, you will be responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You agree not to create an account using false or misleading information or on behalf of someone other than yourself without authorization.

5. Pricing and Payment

5.1 Pricing Structure

Our current pricing is as follows:

• Design Service: Free (with watermarked preview)
• Digital File Download: ₹39 per design (high-resolution PDF & PNG, no watermark, 300 DPI)
• Acrylic Stand: ₹199 + ₹49 delivery (pan-India shipping)
• A6 Stickers (Pack of 2): ₹49 + ₹49 delivery (pan-India shipping)

All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless otherwise stated.

5.2 Price Changes

We reserve the right to change our prices at any time. Price changes will not affect orders already placed and paid for. We will provide reasonable notice of significant price changes by posting on our website.

5.3 Payment Processing

All payments are processed securely through Razorpay, our third-party payment processor. By making a purchase, you agree to Razorpay’s terms of service and privacy policy. We do not store your payment card information on our servers.

5.4 Payment Methods

We accept the following payment methods through Razorpay:

• Credit Cards (Visa, MasterCard, American Express, RuPay)
• Debit Cards
• Net Banking
• UPI (Google Pay, PhonePe, Paytm, etc.)
• Digital Wallets (Paytm, PhonePe, Mobikwik, etc.)

5.5 Taxes

All prices include applicable Goods and Services Tax (GST) as per Indian tax laws. We will provide a tax invoice for all purchases upon request.

5.6 Payment Failures

If your payment fails or is declined, we will notify you and you will not receive access to the paid features until payment is successfully completed. We are not responsible for payment failures due to issues with your bank, payment method, or internet connection.

6. Refund and Cancellation Policy

For detailed information about refunds and cancellations, please refer to our Refund Policy. By using the Service, you agree to the terms of our Refund Policy.

6.1 Digital Products

• No refunds after download (digital goods are non-returnable)
• Full refund if QR code is unscannable due to our error
• Refunds processed within 7-10 business days to original payment method

6.2 Physical Products

• Cancellation allowed before production (within 2 hours of order)
• Full refund for damaged/defective products (return required)
• Replacement offered for manufacturing defects

7. Shipping and Delivery

For detailed information about shipping, please refer to our Shipping Policy. Key points include:

• Delivery Fee: ₹49 flat rate for pan-India delivery (both Acrylic Stands and Stickers)
• Delivery Time: 5-7 business days for most locations in India
• Tracking: Tracking number provided via email/SMS once shipped
• Undeliverable Orders: If delivery fails due to incorrect address or unavailability, additional charges may apply for re-delivery

8. User Content and Uploads

8.1 Your Content

When you upload QR codes, logos, images, or text to our Service (“User Content”), you retain all ownership rights to that content. However, you grant us a limited license as described below.

8.2 License to Use Your Content

By uploading User Content, you grant QRCraft.in a non-exclusive, worldwide, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of:

• Providing the Service to you (generating your custom QR code designs)
• Processing and fulfilling your orders (digital downloads, Acrylic Stands, Stickers)
• Improving and developing our Service

This license terminates when we delete your User Content from our servers (within 24 hours for uploaded files, 7 days for downloaded designs).

8.3 Content Restrictions

You agree not to upload or create designs containing:

• Illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
• Content that infringes intellectual property rights, privacy rights, or any other rights of third parties
• Content that violates any applicable law or regulation
• Malware, viruses, or any malicious code
• Content that promotes violence, discrimination, or hatred against individuals or groups
• Sexually explicit or pornographic content
• Content related to illegal drugs, weapons, or other contraband
• Misleading, fraudulent, or deceptive content

8.4 Copyright and Trademarks

You represent and warrant that:

• You own or have the necessary rights to use all User Content you upload
• Your User Content does not infringe any third-party intellectual property rights
• You have obtained all necessary permissions for any logos, trademarks, or copyrighted material you use

We are not responsible for verifying the ownership or legality of User Content. You are solely responsible for ensuring you have the right to use all content in your designs.

8.5 Content Removal

We reserve the right to remove, refuse to display, or disable access to any User Content that violates these Terms or that we deem inappropriate, without prior notice. We may also terminate or suspend your access to the Service for violations.

8.6 Automatic Deletion

To protect your privacy, we automatically delete:

• Uploaded files (QR codes, logos, images) within 24 hours of upload
• Downloaded design files after 7 days

After these periods, you will need to re-upload and recreate your design if needed.

9. Intellectual Property Rights

9.1 Our Intellectual Property

The Service, including its design, graphics, user interface, templates, software, and all content provided by QRCraft.in (excluding User Content), is owned by us and protected by Indian and international copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks (collectively, “Marks”) may not be used without our prior written permission.

9.2 Templates

All templates provided on the Service are the intellectual property of QRCraft.in. By purchasing a digital download or physical product, you receive a license to use the template solely for your own business purposes. You may not:

• Resell, redistribute, or sublicense templates to third parties
• Claim ownership of template designs
• Use templates to create competing products or services

9.3 Unsplash Images

Background images sourced through our Unsplash integration are subject to the Unsplash License. These images are free to use for commercial and non-commercial purposes without permission or attribution (though attribution is appreciated).

9.4 License to Use Our Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or business purposes.

10. Prohibited Uses

You agree not to use the Service for any of the following purposes:

• Any unlawful purpose or in violation of these Terms or any applicable laws
• To create QR codes linking to illegal, harmful, or malicious content
• To impersonate any person or entity, or falsely represent your affiliation with any person or entity
• To engage in any fraudulent, deceptive, or misleading activities
• To upload viruses, malware, or any other malicious code
• To interfere with or disrupt the Service or servers/networks connected to the Service
• To attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• To scrape, spider, crawl, or use automated means to access the Service without our express permission
• To reverse engineer, decompile, or disassemble any part of the Service
• To use the Service to send spam, phishing attempts, or unsolicited communications
• To violate the intellectual property rights of QRCraft.in or any third party
• To use the Service in a way that could damage, disable, overburden, or impair our servers

Violation of any of these prohibitions may result in immediate termination of your access to the Service and may subject you to legal action.

11. QR Code Scannability Guarantee

We take great care to ensure that all QR codes generated through our Service are scannable. However, QR code scannability can be affected by various factors:

11.1 Our Guarantee

We guarantee that QR codes designed using our templates and guidelines will be scannable when:

• Printed at the recommended minimum size (2″ x 2″ for standard scanning distance)
• Printed on a non-reflective, flat surface with adequate contrast
• Logos do not exceed 30% of the QR code area (our editor warns you if this threshold is exceeded)
• The design is not altered after download

11.2 Factors Outside Our Control

We cannot guarantee scannability if:

• The QR code is printed too small or on unsuitable materials (highly reflective, curved, textured)
• Poor printing quality or smudged printing
• Extreme lighting conditions (too dark, too bright, strong glare)
• You modify the QR code design after downloading
• The original UPI link/data you provided was invalid
• The scanner app or device used is outdated or malfunctioning

11.3 Testing Recommendation

We strongly recommend testing your printed QR code with multiple smartphones and QR scanner apps before mass production or distribution.

11.4 Remedy for Unscannable QR Codes

If your QR code is unscannable due to an error on our part (design flaw, incorrect encoding), we will:

• Provide a corrected design free of charge, or
• Issue a full refund at your choice

12. Third-Party Services and Links

12.1 Third-Party Integrations

Our Service integrates with the following third-party services:

• Razorpay: Payment processing
• Unsplash: Background image search and downloads
• Google Analytics: Usage analytics
• Courier Partners: Shipping and delivery (Delhivery, Blue Dart, India Post, etc.)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

12.2 Third-Party Links

The Service may contain links to third-party websites or resources. We provide these links for your convenience but do not endorse or assume responsibility for the content, products, services, or practices of these third parties.

You access third-party websites at your own risk and subject to the terms and conditions of those websites.

13. Disclaimers and Limitations of Liability

13.1 “AS IS” and “AS AVAILABLE” Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, QRCraft.in disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components
• Warranties regarding the accuracy, reliability, or completeness of the Service or any content

13.2 No Guarantee of Results

We do not guarantee that:

• Use of the Service will increase your business revenue or customer engagement
• QR codes will always scan in all environments or with all devices
• Physical products will be delivered by a specific date (delays may occur due to courier issues, weather, strikes, etc.)
• The Service will meet your specific requirements or expectations

13.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, QRCRAFT.IN, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damage to reputation or goodwill
• Any damages arising from your use or inability to use the Service
• Any damages arising from errors, mistakes, or inaccuracies in the Service
• Unauthorized access to or alteration of your data or User Content
• Acts or omissions of third parties (payment processors, courier partners, etc.)

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹500, WHICHEVER IS GREATER.

13.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless QRCraft.in, its directors, officers, employees, contractors, agents, affiliates, and partners from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of a third party, including intellectual property rights
• Your User Content and any claims that it infringes third-party rights or violates applicable law
• Any fraudulent, negligent, or unlawful acts or omissions by you

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

15. Termination

15.1 Termination by You

You may stop using the Service at any time. Since no account registration is required, simply cease accessing the Service.

15.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Uploading prohibited or infringing content
• Abusive behavior toward our staff or other users
• Any conduct that we deem harmful to the Service or other users

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We will delete your User Content in accordance with our data retention policy
• Sections of these Terms that by their nature should survive termination (including intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute resolution) will remain in effect
• You will remain liable for all payments due up to the date of termination

16. Dispute Resolution and Governing Law

16.1 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Navi Mumbai, Maharashtra, India.

16.3 Informal Resolution

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days.

16.4 Arbitration (Optional)

If informal resolution is unsuccessful, you may choose to resolve the dispute through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Navi Mumbai, Maharashtra, by a sole arbitrator mutually agreed upon by both parties.

16.5 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the “Last Updated” date at the top of this page
• Post a notice on our website for at least 30 days
• For material changes, we may notify you via email (if we have your email address)

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

If there is a conflict between these Terms and mandatory consumer protection laws, the consumer protection laws will prevail to the extent of the conflict.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God (earthquakes, floods, storms, pandemics)
• War, terrorism, civil unrest, riots
• Government actions, laws, or regulations
• Labor strikes or disputes
• Failure of telecommunications, internet, or power services
• Failure of third-party service providers (payment processors, couriers)

In the event of a force majeure, we will make reasonable efforts to notify you and resume performance as soon as practicable.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

22. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

23. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations hereunder to any third party without your consent or notice.

24. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and QRCraft.in regarding the use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals (whether oral, written, or electronic) between you and us.

25. Language

These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.
